Availability and Quality of Service

We are constantly improving our Services to enhance your experience. The Services may undergo modifications and changes, such as, but not limited to alterations to the art style of Assets, adjustments to the algorithms used to generate the Assets, and updates to available features for the Customer. However, we do not provide any guarantees regarding the quality, stability, uptime, or reliability of the Services. It is important to refrain from relying too heavily on any specific attributes of the Services or the Assets. We shall not be held liable for any damages incurred due to your dependence on the Service. Both the Services and the Assets are provided to the Customer on an "AS IS" basis, without any express or implied warranties or conditions, including but not limited to warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. It is your sole responsibility to assess the appropriateness of using or redistributing the Assets and to assume any associated risks when utilizing the Services. AIPetPhotos.com retains the right to suspend or terminate your access to the Services at any time and for any reason. Usage of the Services for competitive research is prohibited. Reverse engineering of the Services or the Assets is not permitted. Automated tools may not be used to access, interact with, or generate Assets through the Services. Each registered account is limited to one user, and each user may only possess a single account. We reserve the right to investigate any complaints or reported violations of our Terms of Service. We may take appropriate actions, including but not limited to reporting suspected unlawful activity to law enforcement officials, regulators, or third parties. Furthermore, we may disclose any necessary or appropriate information to such individuals or entities, including user profiles, email addresses, usage history, posted materials, IP addresses, and traffic information.

Age Requirements

By accessing the Services, you acknowledge that you are 18 years old and meet the minimum age required for digital consent in your country. If you meet the age requirements to access the Services but do not have the authority to consent to our terms, it is necessary for your parent or guardian to agree to our terms on your behalf. We encourage you to involve your parent or guardian in reading these terms together. If you are a parent or legal guardian and you permit your teenager to use the Services, these terms also apply to you, and you are responsible for overseeing your teenager's activities on the Services. AIPetPhotos.com strives to create Services that are suitable for audiences aged 13 and above and family-friendly. However, please note that the Assets are generated by an artificial intelligence system based on user queries. Since this is a new technology, it may not always function as expected. We do not guarantee the suitability of the Assets for individual Customers.

Your Information

By using the Services, you may provide AIPetPhotos.com with personal information such as your email address, username, billing details, preferred selections, image outputs, and text prompts entered, as well as sample images uploaded to the Service. Our policy, which details how we handle your personal information and the rights you possess in relation to it, can be found aipetphotos.com/privacy. Both parties agree to comply with all applicable data protection laws. If additional terms concerning data privacy or data transfers are necessary, the parties will collaborate in good faith to establish such terms.

Intellectual Property Rights

While you retain ownership of your original pet photos, the AI-generated portraits are subject to the following terms:

• Personal use rights for all generated images
• Commercial use requires a separate license
• AI Pet Photos retains the right to use generated images for promotional purposes

Takedowns Policy

AIPetPhotos.com uses an artificial intelligence system that has been trained on publicly available datasets to generate its Assets. As a result, these Assets may inadvertently resemble copyrighted material or trademarks that you own. We respect rights holders internationally. If you believe that the Service is infringing upon your copyright or trademark, please contact us at support@AIPetPhotos.com, and we will promptly address your request.

Dispute Resolution and Governing Law

Any legal claims or disputes arising from or relating to this Agreement, including disputes regarding its interpretation or performance, will be governed by the laws of the country of Singapore. The parties involved will make good faith efforts to resolve any Dispute within 30 days from the time it arises. If the Dispute remains unresolved after the 30-day period, it will be resolved through arbitration under the Expedited Commercial Rules of the Singaporean Arbitration Association's International Centre for Dispute Resolution, which are in effect at the time of this Agreement. Both parties will jointly select a single arbitrator. The arbitration proceedings will be conducted in English and take place in Singapore. Either party may seek injunctive relief from any competent court to safeguard their rights until the arbitration process is completed. The arbitrator may issue equitable or injunctive relief consistent with the remedies and limitations specified in the Agreement. The arbitral award will be final and binding on both parties, and it can be enforced in any competent court, including those with jurisdiction over either party or their assets. Each party will be responsible for covering its own legal and expert fees and expenses, regardless of the arbitrator's final decision regarding the Dispute.

Ownership

Customer Ownership: By using our services, you maintain complete ownership of all photos and data that you upload, store, or transmit through our platform. We do not assert any rights or ownership over your photos or data. Non-Usage Without Explicit Consent: We are dedicated to respecting your privacy and ensuring the security of your photos and data. Without obtaining your explicit consent, we will not use, sell, rent, or exploit your photos or data in any way. Consent for Specific Purposes: In certain circumstances, we may seek your explicit consent to use your photos or data for specific purposes outlined in separate agreements, features, or functionalities within our services. Such consent will be obtained separately, and we will only utilize your photos or data in accordance with the terms specified in the specific consent provided. Limited Data Processing: We may process your photos and data solely for the purpose of delivering our services to you, including activities such as storage, retrieval, backup, and data analysis. These processes will be conducted in compliance with applicable privacy laws and regulations. Data Security Measures: We employ reasonable security measures to safeguard your photos and data from unauthorized access, disclosure, alteration, or destruction. However, please be aware that no method of transmission over the internet or electronic storage can guarantee 100% security. As a result, we cannot provide absolute security assurances. Third-Party Access: We will not grant any third parties access to your photos or data, except in cases where it is required by law, necessary to fulfill legal obligations, enforce our rights, prevent fraud, or protect the rights, property, or safety of our users. Data Deletion: Any data will be automatically deleted 30 days after its usage. Upon your request or termination of your account, we will delete your photos and data from our active databases, subject to any legal obligations or technical limitations that may prevent us from doing so. Please note that residual copies of your photos or data may remain in our backup systems for a limited period of time.

Payment and Billing

We may send you an invoice for your usage of the Services, which will be facilitated by a third-party payment service provider. In case of any conflict, the terms of service of the third-party provider will take precedence over this Agreement. You have the freedom to cancel your plan at any time. Likewise, we retain the right to terminate your access to the Service for various reasons, including violations of the Community Guidelines or inappropriate use of the Service. In the event of cancellation or termination, any outstanding usage fees will be immediately charged.

Community Guidelines

• Show kindness and respect towards others and our staff. Avoid creating images or using text prompts that are inherently disrespectful, aggressive, or abusive. Any form of violence or harassment is strictly prohibited.
• Adult content and gore are not allowed. Please refrain from creating visually shocking or disturbing content.
• Respect others' creations. Do not publicly repost the work of others without obtaining their permission.
• Exercise caution when sharing. While it's acceptable to share your creations outside of the AIPetPhotos.com community, please consider how others may perceive your content.

Failure to adhere to these guidelines may result in bans from our services.

Limitation of Liability and Indemnity

We provide the service "as is" and make no guarantees or promises regarding its performance. You acknowledge and agree that we will not be held liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential, or exemplary damages, regardless of how they arise. You are responsible for your use of the service. If you cause harm to someone else or become involved in a dispute with another party, we will not be involved in such matters. In the event that you knowingly infringe upon someone else's intellectual property rights, resulting in financial consequences for us, we reserve the right to pursue legal action to recover the incurred costs. This may include seeking court intervention to make you liable for our attorney's fees and other appropriate actions. It is important that you do not engage in such activities.

Miscellaneous

Force Majeure: Neither party will be held responsible for any failure or delay in performance resulting from circumstances beyond their reasonable control, such as acts of God, natural disasters, terrorism, riots, or war. No Agency: This Agreement does not establish an agency, partnership, or joint venture relationship between the parties. Severability: If any part of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions of the Agreement will remain in effect. No Third-Party Beneficiaries: Unless explicitly stated, this Agreement does not grant any benefits or rights to third parties. Survival: The sections and obligations in this Agreement that are expected to continue beyond the termination of this agreement, such as those relating to intellectual property and privacy, will remain in effect.
